Family look to make compensation claim after fatal farm accident in Shropshire

A family based in the UK are looking to make a compensation claim after they lost their father and husband in a fatal accident. The 48-year-old was killed whilst operating machinery at a farm in Shropshire in May 2009. It is now believed that his family may be eligible to claim for the damages on his behalf.

The accident victim suffered fatal head injuries when he was hit by the rotating arms of a bale wrapping machine.

At the time of the accident he was preparing equipment for use in the grass cutting season. He was pronounced dead at the scene by paramedics.

The Health and Safety Executive (HSE) conducted an investigation into the incident and found that a defective machine supplied by McHale Engineering was to blame.

The machine’s safety trip bar had not been programmed correctly meaning that it was not able to stop the rotating arms quickly enough when it was activated.

“Manufacturers of farm equipment should ensure that they design such equipment so that safety risks are reduced as far as possible for anyone who enters the danger zone of the rotating arms,” a spokesperson from the HSE said.

He added that the tragedy could have been stopped if the engineering company had made sure the machine could be stopped in a safe manner.
